What this covers
These terms apply when you use the VirAR card builder or order a card, digital or printed. Using the site means you accept them. If you do not agree to these terms, please do not place an order.
They sit alongside our Privacy Policy and Cookies, which cover what happens to your data.
Placing an order
Building a card commits you to nothing. A contract exists only once you have paid and we have confirmed the order by email.
We may decline an order — and refund it in full — if the content breaks the rules below, if the print partner cannot fulfil it, if the delivery address is unreachable, or if an obvious error caused an incorrect price to be displayed. We will always tell you why.
Nothing is sent to a printer before payment is confirmed. That is enforced in the system itself, not by policy: an unpaid order simply never reaches production.
Prices and payment
- All prices are in US dollars.
- The total is made up of the AR fee, the printed product plus our stated markup, and shipping at the print partner's cost. The full formula is on the pricing page.
- Printing and shipping are quoted live for your size, paper and destination, so the final figure appears at checkout rather than earlier.
- Prices exclude local sales tax, VAT and import duty. Where a destination applies them, they are added at checkout or collected on delivery under that country's rules.
- Payments are processed by Stripe. We never see or hold your card number.
The content you upload
Your photos, videos and words stay yours. We claim no ownership of them.
By uploading, you confirm that you have the right to use that content and to have it printed and shown — that you took it, or have permission from whoever did, and that anyone recognisable in it would not object to it being put on a card.
You grant us a limited licence to store, process, reformat and display your content strictly for the purpose of building your card, producing the print file and serving the AR scene to whoever scans it. That licence ends when the content is deleted. It does not let us use your material for marketing, and it does not let us pass it to anyone except the processors listed in the privacy policy.
What you may not put on a card
- Anything you do not hold the rights to — including licensed music in a video.
- Sexual content involving minors, in any form. This is reported, not merely refused.
- Content that harasses, threatens or targets a specific person.
- Hate speech, or material promoting violence against a group.
- Intimate images of someone shared without their agreement.
- Anything illegal where it is being made or delivered.
We do not screen every card, and we do not want to read your messages. But if something in this list is reported or found, we will refuse or cancel the order, delete the content, and where the law requires it, report it.
The AR layer
- Every ordered card's AR scene stays live for one year from the order date. We email a reminder about 30 days before that runs out, and it can be renewed.
- The AR experience runs in a phone's browser and needs a working camera, a network connection and adequate light. We cannot guarantee it on every device ever made, particularly very old phones or browsers embedded inside other apps.
- How reliably the printed photo is recognised depends partly on the image you chose. We explain what works in the help pages; a low-contrast or near-empty image is harder for any camera to track.
- We may improve or change how the AR viewer works. We will not knowingly break a card that is still within its year.
What printing can and cannot promise
- Colour on paper never matches a backlit screen exactly. Small differences in shade are normal and are not a fault.
- Trimming has a tolerance of a millimetre or two. That is why the builder keeps a safe area away from the edge.
- A low-resolution photo will look soft in print even though it looked fine on screen. The builder warns you when an image is too small for the size you chose.
- Paper stock varies slightly between production runs and between partners.
Cancelling, returns and refunds
Before it goes to print
Contact us as soon as possible. If the order has not yet been passed to the print partner we will cancel it and refund it in full.
After it goes to print
A card carrying your own photographs, video and words is made specifically for you. Under EU consumer law — Article 16(c) of Directive 2011/83/EU, and its equivalents elsewhere — personalised goods are excluded from the usual 14-day right to change your mind, and that exclusion applies here once production has started.
If something is actually wrong
That exclusion does not touch your statutory rights over faulty goods. If the card arrives damaged, is misprinted, does not match what you designed, or the AR layer does not work, we will reprint it or refund it. Send us the order number and a photograph of the card as it arrived, within 30 days of delivery.
If it never arrives
Tell us. We will chase the print partner and, where the parcel is genuinely lost, reprint or refund. You should not have to argue with a courier on our behalf.
Liability
We are responsible for delivering what you ordered: a correctly produced card with a working AR layer. Where we fail at that, our liability is limited to the amount you paid for that order.
We are not liable for indirect or consequential losses — for example a card that misses an occasion because a courier was delayed. We will always try to fix it, but we cannot insure your birthday.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected by anything on this page.
Our own material
The VirAR name, the site, the card builder, the AR engine and our template designs belong to us. Buying a card gives you the card and the right to use it, not a licence to reproduce our templates or software.
Stock photos, icons and fonts offered inside the builder are licensed for use on cards you create with us. They do not come with a licence to extract and use elsewhere.
Legal information
- VirAR is operated by Roman Vainshtain, an independent developer in Gdańsk, Poland — ul. Obrońców Wybrzeża 11, Gdańsk, Poland — currently as unregistered business activity (działalność nierejestrowana) under Polish law. That form carries no company or VAT number, which is why none is listed. It does not reduce your rights: the seller still counts as a trader under EU consumer law, and every obligation in this document applies in full.
- These terms are governed by Polish law, and any dispute goes before the competent Polish courts. If you are a consumer, that does not take away the protection of the mandatory consumer-law rules of the country you live in, nor your right to bring a claim there.
- If any single clause here turns out to be unenforceable, the rest still stands.
- We may update these terms. The version that applies to your order is the one published when you placed it.
- We can decline service to anyone who repeatedly breaks these terms.
